COPPA Notice

Classkick’s mission is to ensure that students everywhere get the help they need at the moment they need it. We’re honored to partner with teachers and educators around the world who trust Classkick to do that every day. Ensuring students’ privacy is important to us in maintaining that trust.

Accordingly, this COPPA Notice (the “Notice”) is designed to comply with the Children's Online Privacy Protection Act ("COPPA") and is meant to serve as direct notice of Classwork Co. d/b/a Classkick’s (“Classkick,” “we,” “us,” and “our”) collection, disclosure, and use of student personal information, as permitted by the parents and school or school district (“you” and “your”) of such students under COPPA. This Notice applies to all products and services offered by Classkick, including but not limited to any and all websites, applications, educational resources, and other online and digital platforms owned, operated, or provided by Classkick (collectively, the “Service”). For the purposes of this Notice, "child" or "children" means a child or children under 13 years old.

Pursuant to COPPA, Classkick is required to obtain verifiable consent before collecting, using, or disclosing student personal information. To do this, Classkick relies on schools, school districts, and other similar educational institutions (each an “Institution”), as well as teachers, school leaders, aides, and other similar personnel (“School Personnel”) accessing the Service on behalf of such Institutions, to provide consent on behalf of parents and legal guardians, as permitted under COPPA.

As such, you are receiving this Notice because:
  1. we have received your contact information and, as School Personnel or an Institution, you intend to use our Service, and we are seeking your consent to our collection, use, and disclosure of student personal information, as permitted under COPPA; or
  2. you are a parent or legal guardian whose child’s School Personnel or Institution has contracted with us to use our Service, and such School Personnel and Institution (i) has consented to our collection, use, and disclosure of student personal information, as permitted under COPPA, and (ii) is obtaining your consent for your child to use the Service and providing you with this Notice, our Terms of Service, and our Privacy Policy, as required by us.

Classkick will not collect, use, or disclose student personal information without first obtaining consent from School Personnel or Institutions, or where Classkick otherwise becomes aware that a parent or legal guardian of a student using the Service opposes the collection, use, or disclosure of the student’s personal information and wants to rescind the consent provided to us by the student’s School Personnel or Institution.  

If you are School Personnel or an Institution and we do not receive the necessary consent from you in a reasonable period of time after you receive this notice, we will delete your contact information from our records, and no student personal information from your Institution will be collected, used, or disclosed.

If you are a parent or legal guardian of a child who has created a Classkick account, and you were not informed by your child’s teacher or school that your child is using the Service, you can email us at support@classkick.com to delete your child’s account deleted, to obtain copies of any personal information we have collected about your child, or to refuse to permit us to collect further personal information from your child. Please keep in mind that to fulfill any such requests we will need to verify your identity—for example, by requiring that you provide acceptable forms of personal identification.

What is Classkick, and how do School Personnel and Institutions provide consent?

Classkick is a platform that helps teachers provide feedback to students in real-time. Teachers use Classkick to monitor student work and give students feedback while working. They use the Classkick App or the Classkick Website - if multiple devices are used, they will all sync with each other.

School Personnel and Institutions provide the consent necessary under COPPA by purchasing a Classkick Pro Membership or otherwise contracting with us and engaging our Service. Students access Classkick using a class code provided by their teacher and cannot create an account by themselves unless they are invited to Classkick by a teacher or school administrator to use Classkick’s Service. When students set up a Classkick account, they create a unique username and password, or sign in using a third party sign-in service, such as their Google account. However, before any such account is created, or student personal information is collected, used, or disclosed, each student’s teacher or Institution will obtain parental consent and make this Notice, our Terms of Service, and our Privacy Policy available to such parents so everyone is fully informed of what we do and how we manage our privacy practices, as explained above.

What information does Classkick collect from children, and how does Classkick use such information?

Classkick collects the minimal amount of information from students necessary to work or create accounts on our Service. Where students have permission to use Classkick, we collect their name, unique username or email address, password, class code provided by their teacher to connect with a class, and school name. This information may be entered by a teacher or the student or populated from the student’s account with a third party sign-in service, such as their Google account. If teachers make such information available to us, we may also collect the grade students are in.  If a student’s teacher elects to utilize Classkick, the student may further draw, type, take photos, add audio or links, and upload other classroom-related assignments or content that may contain student personal information. This student content and other student personal information will be collected and used by Classkick for the educational purposes authorized by the student’s Institution and to otherwise provide the Service requested by such Institution.

Classkick also automatically collects online behavior information including online activity, preferences, and time spent viewing features; IP address, mobile network information, or device information, such as operating system, browser type, browser language, hardware version, device settings, file and software names and types, battery and signal strength, and device identifiers; and device event information, such as crashes, system activity, and support requests and the date and time of such requests and referral URL. This information is used by Classkick to maintain and improve its Service.

If students use Classkick on different devices, we may link the information we collect from those different devices to help us provide a consistent Service across their different devices. If we do combine any automatically-collected information with personal information, we will treat the combined information as personal information, and it will be protected as per this Notice and our Privacy Policy. We may use cookies and other tracking mechanisms to track information about students’ use of our Service and engage third parties, such as Google Analytics and Posthog, to track and analyze data from our Service and to evaluate usage of our Service.

How does Classkick share the student information it collects?

Classkick does not trade, sell, or rent any personal information to third parties, including for advertising or marketing purposes. Targeted advertising is not permitted on Classkick. However, in accordance with applicable law, student personal information may be shared where parents, teachers, or schools provide consent for such disclosure; where parents, teachers,  or schools voluntarily make such information publicly available; with Classkick’s service providers; in the event of a sale or change in control of Classkick; and where otherwise required by law.
